The terms behind every stone we sell.

Plain language. Sri Lanka law. Written so a collector in São Paulo and an atelier in Geneva can read the same page and understand the same agreement.

The agreement

These Terms govern every sale made by GEMSTORE.LK ("we", "us", "the maison"), an Eheliyagoda-based gemstone exporter operating under Sri Lanka law, to a buyer ("you") anywhere in the world. By placing an order — by WhatsApp, email, the site inquiry form, or our atelier — you accept these Terms.

Inquiry and order

An inquiry is not yet an order. An order is formed when (a) we issue a written quotation that names the specific stone, its lab certificate number, the price, and the shipping terms; and (b) you confirm in writing and complete the agreed payment step.

Until both steps are complete, the stone remains available for other inquiries. We never reserve a stone against an unpaid promise. If a stone you have inquired about is sold to another buyer first, we will tell you within 24 hours and refund any deposit in full.

Certification

Every stone listed on this site ships with an independent gemmological report from GIA, GRS, or SSEF. The report is included in the price, except where you specifically request an alternative laboratory (e.g. AGL, Lotus) — in which case re-grading fees and additional transit time may apply.

Stated weights, dimensions, treatments, and origin are taken from the report. We disclose treatments in full. We never re-label material from non-Sri-Lankan origin as Ceylon.

Pricing and taxes

All listed prices are in US Dollars, ex-works Eheliyagoda, exclusive of destination duties and import taxes. We will quote a final landed price including insured shipping on request.

Import duty and VAT in your country are your responsibility. We provide all paperwork (commercial invoice, certificate of origin, lab report) needed for clearance and we do not under-declare value.

Payment

Accepted payment methods, in order of preference:

  • SWIFT bank transfer to our nominated USD account.
  • Escrow (Escrow.com or comparable, fees split equally) — recommended for first-time buyers and orders above USD 25,000.
  • Approved cards via Stripe for orders below USD 5,000 (3% processing surcharge applies).

Stones do not leave the atelier until cleared funds are received. Wire fees are paid by the sender; please instruct your bank with "OUR" charges so the full quoted amount arrives.

Shipping and title

We ship insured, signature-on-delivery, via FedEx Priority, DHL Express, or Malca-Amit, depending on destination and value. Detailed shipping terms — transit times, restricted countries, customs handling — are on our Shipping page.

Risk passes from us to you at the point of delivery to the named recipient at the shipping address. Title passes when (a) full payment has cleared and (b) delivery is complete. Until both, the stone remains our property.

Inspection and refund

You have a 7-day inspection window from the date of delivery. Within that window, you may submit the stone for independent re-grading at GIA, AGL, GRS, or SSEF. If the second report shows any material deviation from the specifications we sold you, we will:

  • Refund the full purchase price including original shipping;
  • Reimburse the second laboratory's grading fee;
  • Cover return shipping (insured, our nominated courier).

If the second report confirms our specifications, you may still return the stone within the 7-day window for any reason; in that case shipping and re-grading costs are yours, and the stone must arrive back in original condition with all paperwork.

Custom-cut, custom-mounted, and engraved pieces are exempt from the no-reason return option but retain the deviation-from-spec guarantee in full.

Warranties we make

  • The stone matches the laboratory certificate that accompanies it.
  • Origin is as stated. Treatment is as stated. Both are disclosed in writing.
  • The stone has clean title and is exported under valid Sri Lanka National Gem and Jewellery Authority licence.
  • We are the original cutter or a direct second owner. The chain is short and documented.

Limitation of liability

Our total liability for any claim arising out of or related to a sale is limited to the amount you paid for the stone in question. We are not liable for indirect, consequential, or punitive damages, lost profits, or loss of goodwill. Nothing here limits liability for fraud, gross negligence, or anything that cannot be limited under applicable law.

Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control: natural disaster, war, civil unrest, courier strikes, customs holds, banking system failures, or government-imposed restrictions. We will keep you informed and propose alternatives where possible.

Governing law and disputes

These Terms are governed by the laws of Sri Lanka. We will always try to resolve a dispute in writing, in good faith, within 30 days. If that fails, the dispute is referred to arbitration in Colombo under the rules of the Sri Lanka National Arbitration Centre, in English, by a single arbitrator. Either party may seek interim relief from a competent court.

If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer rights, those rights are not affected by anything in this section.
